Conditions
scope
For the business relationship between sugarmillion GmbH (sugarmillion) and the person ordering goods via the online sales platform at www.sugarmillion.com (sugarmillion online shop), the following General Terms and Conditions (GTC) apply exclusively.

Goods within the meaning of these GTC are all products and services that can be purchased as part of an online order in the sugarmillion online shop.

The following terms and conditions do not apply to orders placed with sugarmillion outside of the sugarmillion online shop.

conclusion of contract
(1)
The presentation of goods in the sugarmillion online shop does not constitute a binding offer to conclude a purchase contract.

(2)
Only adults who have a residential address in Switzerland or Liechtenstein can order.
​
(3)
With your order - by clicking the "buy now" button - you make a binding offer to purchase. Sugarmillion will send you an automatic acknowledgment of receipt by e-mail, which documents your order again. This automatic acknowledgment of receipt merely confirms that sugarmillion has received your order and does not constitute acceptance of your application.

(4)
Depending on the payment method selected, Sugarmillion reserves the right to check your details regarding the payment method, its validity, your creditworthiness in relation to the order value, your personal credit limit and, depending on the result of the check, to refuse to accept orders.

(5)
The contract with Breuninger is only concluded when Breuninger confirms the shipment of the goods to you by separate email. The acceptance period is a maximum of 7 calendar days.
​
(6)
If it is not possible to deliver the goods you have ordered, for example because the goods in question are not in stock, Breuninger will refrain from issuing a declaration of acceptance. A contract is not concluded in this case. We will inform you of this immediately and immediately refund any consideration already received.

(7)
The contract is concluded exclusively in German.

(8th)
Your order data will be stored by us within the framework of the legal provisions. If you have registered in the sugarmillion online shop, you can call up your order data at any time. If you lose your records of your orders, please email us at contact@sugarmillion.com. We will be happy to send you a copy of the data stored about your order.

§3 Voluntary right of return
(1)
All goods are non-returnable. A right of exchange is only granted if the goods are defective.

(2)
We reserve the right to check shopping behavior at regular intervals and, if a critical return threshold of 90% of all online purchases made is exceeded, to temporarily block the respective customer account within 6 months, up to 6 months.
§4 Retention of title
(1)
The goods remain the property of sugarmillion until the claim has been paid in full.
§5 Delivery
(1)
The goods are shipped by sugarmillion exclusively to delivery addresses in Switzerland and Liechtenstein.
(2)
Unless other delivery times have been agreed, the delivery time is up to five working days from receipt of the order, unless a shorter period is specified in the ordering process.
§6 prices / shipping costs / customs costs
(1)
The prices listed in the offer at the time of the order apply.

All prices stated in the sugarmillion online shop are in Swiss francs including statutory VAT at the statutory rate.

(3)
Any other costs, such as delivery and shipping costs, will be shown separately. Customs costs are always at the expense of the customer and are not calculated or shown in advance. The customs formalities are included with every package so that customs clearance can be completed as quickly as possible. The invoice from the respective customs office is sent to the customer separately and is not our responsibility.
§7 Terms of payment, means of payment
(1)
You can pay in advance and pay via PayPal. The time of payment/debit varies depending on the means of payment:
Payment with PayPal: Your PayPal account will be debited upon completion of the order.
Payment in advance: The charge is made according to your value date.
(2)
Unless otherwise agreed, payment of the purchase price is due immediately upon conclusion of the contract.
§8 Warranty
Sugarmillion is liable for material and legal defects according to the applicable statutory provisions, in particular Art. 197 ff. OR. The right to the warranty must be asserted in court within two years. The period begins on the day the goods are delivered, but in the case of defects of title only on the day on which the customer becomes aware of the defect.
§9 Copyrights
The content and structure of the Sugarmillion online shop and the other websites operated by sugarmillion are protected by copyright. All text, images, graphics, sound, video and animation files are subject to copyright, trademark law and other intellectual property protection laws. Some Internet pages also contain images, graphics, sound, video and animation files that are subject to copyright, trademark law and other intellectual property protection laws of those who made them available. Copying or other use for other than private purposes or for passing on, other publication, duplication and distribution, whether in original or modified form and in any medium, or such use on other websites is not permitted without the prior express written consent of sugarmillion.
§10 data protection
With regard to the regulations relating to data protection and data backup, reference is made to the separate data protection declaration, which you can find here, which the customer can save on his computer and/or print out for the purpose of the online order.
§12 Final Provision
(1)
Swiss law applies to the exclusion of the UN Sales Convention (CISG).
(2)
If the customer does not have a general place of jurisdiction in Germany or if he has moved his place of residence abroad after the conclusion of the contract or if the place of residence is not known at the time the action is filed, the place of jurisdiction for all disputes is Solothurn.
(3)
Should individual provisions of this contract with the customer, including these General Terms and Conditions, be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.
